GENERAL TERMS AND CONDITIONS OF SALE

Spa Center & Thalasso - Domaine De Riva Bella

Article 1 : DEFINITIONS

These general conditions of sale apply to all bookings of stays, treatments and other services made via the website www.rivabella-Thalasso & Spa.com. They are intended to govern the relationship between the customer and SAS le Domaine de Riva Bella, a simplified joint stock company with capital of 1,800,000 euros, whose registered office is located at 2693 Chemin Terrenzana, Riva Bella 20230 Linguizzetta, registered with the R.C.S de Bastia under number 434 930 053 00013, intra-community VAT number: FR06434930053.

"WE" and "OUR": this term refers to the Domaine de Riva Bella.

Thalasso & Spa treatments: this term refers to the treatments offered for sale on the WEBSITE.

PURCHASER: this term refers to the contracting party, an individual who, for non-professional purposes, has ordered one or more Thalasso & Spa care products on the Internet site.

BENEFICIARY: this term designates the BUYER or a third party as the beneficiary of the SOIN Thalasso & Spa, depending on whether the BUYER uses the SOIN Thalasso & Spa personally or offers it to a third party.

WEBSITE: this term designates the Riva Bella website: www.rivabella-Thalasso & Spa.com, on which the Thalasso & Spa treatments are presented and sold to the BUYER. It is hosted by SEQUOIASOFT, whose registered office is located at 2693 Chemin Terrenzana, Riva Bella 20230 Linguizzetta and is registered with the R.C.S de Bastia under number 434 930 053 00013, intra-community VAT number: FR06434930053.

ORDER: this term refers to the sales contract between Riva Bella and the BUYER. All orders are made with an obligation to purchase.

PARTIE(S): this term refers jointly or individually to the BUYER and Riva Bella. 

Article 2 : OBJECTIVES

The purpose of these general conditions of sale is to define the general conditions governing the BUYER's relationship with US and the way in which the sale of Thalasso & Spa treatments is offered to BUYERS via this INTERNET SITE.

Consequently, if the BUYER places an ORDER for one or more Thalasso & Spa treatments, this implies that the BUYER has accepted without reservation and has previously complied fully and completely with these general conditions of sale, which will prevail over any other document, unless Riva Bella has expressly accepted special conditions in writing. The PURCHASER acknowledges having read these terms and conditions of sale prior to placing an ORDER.

WE reserve the right to modify these terms and conditions at any time. Nevertheless, the general terms and conditions of sale applicable to the ORDER for Thalasso & Spa treatments placed by a BUYER on the WEBSITE are those accepted by the BUYER at the time of placing the ORDER.

These general terms and conditions of sale supplement the conditions of use of the WEBSITE published at any time under the "Legal" tab of the WEBSITE and applicable to the BUYER. 

Article 3 : SPECIFIC PROVISIONS RELATING TO THE SALE OF THALASSO & SPA TREATMENTS ON THE WEBSITE

Article 3.1 : Book a treatment in our Thalasso & Spa

It is reminded that these general conditions of sale apply solely to the online sale of Thalasso & Spa treatments on the WEBSITE.

To purchase a Thalasso & Spa treatment, the BUYER must go to the WEBSITE and connect to his account by entering his email address and password or by creating an account for which he must enter his title, surname, first name, email address and password. ID must be shown at the appointment.

Consequently, an online ORDER for a Thalasso & Spa TREATMENT implies the following:

WE will send an e-mail confirming and summarising the ORDER. This e-mail contains a unique code enabling the chosen Thalasso & Spa to check that the treatment has not already been given.

Article 3.2 : Restrictions, Extensions & Recommendations

Thalasso & Spa treatments and gift vouchers are valid for 2 (two) years from the date of issue and are non-refundable and non-exchangeable. No exceptions will be accepted. (Unless cancelled by the BUYER). If they are not used within the validity period indicated, neither the PURCHASER nor the BENEFICIARY will be entitled to a refund.

To reserve Thalasso & Spa le Domaine de Riva Bella treatments, the BENEFICIARY must :

Have the confirmation e-mail available. Call the Thalasso & Spa centre to schedule the date and time of the appointment. On the day of the visit, the beneficiary must present his/her confirmation e-mail. Arrive 15 minutes before the appointment time in order to respect the treatment schedule.

Any cancellation must be made at least 48 hours in advance to be eligible for a refund.

Please inform the staff if you have any health problems (circulatory problems, allergies, asthma, etc.) or if you are pregnant (certain treatments may not be recommended). In the event of serious illness or major surgery shortly before the appointment, the beneficiary must provide a certificate of medical fitness issued by the attending physician.

It is also specified that :

The duration of the treatments indicated is estimated. Escapades and packages are indivisible, cannot be changed and must be completed in a single session. The Spa and Thalasso centre is not accessible to people under the age of 16.

Article 4 : COMMON PROVISIONS RELATING TO THE SALE OF THALASSO AND SPA TREATMENTS

Article 4.1 : To book

An ORDER is considered to have been placed on the WEBSITE and the general terms and conditions of sale accepted as soon as the BUYER has validated his/her payment. The data recorded by US and the secure payment provider constitutes proof of the nature, content and date of the ORDER.

If the BUYER double-clicks on the ORDER, this constitutes an electronic signature which has the same value as a handwritten signature. By double-clicking and accepting the general terms and conditions of sale (tick box), the BUYER accepts the ORDER without reservation.

The sale will only be considered definitive once WE have sent the BUYER confirmation of the ORDER and received full payment. WE recommend that the BUYER keeps a paper or electronic copy of the information contained in the confirmation of the ORDER sent by the Riva Bella Estate. Notwithstanding the above, WE reserve the right to cancel any ORDER from a PURCHASER with whom there is a previous payment dispute or for any other legitimate reason, particularly with regard to the abnormal nature of the ORDER, without any compensation being provided by US.

At any time, the BUYER may consult the progress of his ORDER in the eThalasso & Space "My account/My orders" section provided for this purpose.

Article 4.2 : Paiement

The ORDER is paid for online on the WEBSITE (www.rivabella-spa.com) using a debit or credit card (Visa and Mastercard). If a refund is accepted, it will be made using the same means of payment as that used by the BUYER for the initial payment of the ORDER. In the event of the purchase of one or more PRODUCTS and/or Thalasso & Spa treatments on the SITE via a payment card, the BUYER will indicate, directly in the fields provided for this purpose, the following elements: the card number, its validity date, as well as the control code located on the back of the card. The total amount of the ORDER will be debited from the credit card on the day of the ORDER.

If your debit or credit card payment is not processed successfully for any reason, we will not attempt to process the payment again. If the payment is unsuccessful, the ORDER will be cancelled. If you wish to proceed with the ORDER, you will need to place the ORDER again.

The Domaine de Riva Bella gift voucher is valid for two years from the date of purchase. Once expired, the card can no longer be used or refound.

 How to use the Riva Bella gift voucher :

1. To use the Riva Bella gift voucher, go to www.rivabella-spa.com.

2. Choose the treatments you wish to purchase and add them to your basket.

3. Access your basket once you have made your selection.

4. At the checkout stage, enter the unique code of your Riva Bella gift voucher in the "promotional code" field.

5. The amount of your Riva Bella gift voucher will then be deducted from your order. If the amount of your E-card is not sufficient to complete all your purchases, you will be able to complete at the stage payment by bank card. If the value of the e-card is greater than the amount of the purchase, the beneficiary will not receive the difference; the balance is neither refundable nor usable for a future purchase. The entire remaining amount will be lost.

WE reserve the right to suspend all ORDER processing and deliveries in the event of non-payment or refusal of authorisation for payment by bank card by the officially accredited organisations usually found on the Internet.

WE reserve the right to refuse to honour an ORDER from a BUYER who has not paid for all or part of a previous ORDER or with whom there is a payment dispute.

WE reserve the right to refuse to honour an ORDER from a PURCHASER who cannot justify the origin of the e-gift card in their possession.

WE will not be held responsible for any misuse or fraudulent use of any means of payment which has not been detected by the verification process. The PURCHASER warrants to US that he/she has the necessary authorisation to use the method of payment chosen for his/her ORDER.

Any fraudulent use of the credit card will not be eligible for a refund from US.

If you have received a credit on your account at the Domaine de Riva Bella, please note that this cannot be extended beyond the date indicated.Article 4.3 : Sécurité des paiements

Nous prendrons toutes les précautions raisonnables, dans la mesure où cela est en notre pouvoir, pour sécuriser les détails de votre commande et de votre paiement, mais en l'absence de négligence de notre part, nous ne pouvons être tenus responsables de toute perte que vous pourriez subir si un tiers obtient un accès non autorisé à des données que vous avez fournies lors de l'accès ou de la commande sur le site Internet.

Si vous avez bénéficié d'un crédit sur votre compte le Domaine de Riva Bella, sachez que celui-ci ne pourra être prolongé au-delà de la date indiquée.

Article 4.4 : Shipping & Delivery

Delivery of the gift voucher is made directly to the email address provided by the PURCHASER.

The Domaine de Riva Bella undertakes to prepare the ORDER within 24 hours to 2 working days.

Article 4.5 : Delays and cancellations

Any delay may result in a reduction in the duration of the treatment, up to the amount of your delay (in this case, the price of the treatment remains unchanged). If you need to postpone or cancel your appointment, please inform us at least 48 hours in advance; any appointment not cancelled will be billed.

Article 4.6 : Data processing and civil liberties

The information collected by the Domaine de Riva Bella when the BUYER places an ORDER is necessary for the processing of the ORDER by the Domaine de Riva Bella and its commercial partners. The Domaine de Riva Bella undertakes to preserve the confidentiality of the personal data transmitted by the BUYER.

In accordance with the Data Protection Act n°78-17 of 6 January 1978 as amended and the General Data Protection Regulation n°2016/679 dated 27 April 2016, the BUYER has a right of access, rectification, opposition, deletion subject to legitimate grounds, portability of data concerning him,

as well as a right to "digital death". The BUYER may exercise these rights. To exercise these rights, a written request must be made via the contact form by clicking HERE.

The Riva Bella Estate may send promotional offers by post or e-mail, including the e-newsletter, subject to the prior agreement of the BUYER during the registration procedure.

Article 4.7 : Intellectual property

The SITE is an intellectual property protected by the Intellectual Property Act. The elements of the SITE (such as brands, logos, photographs, images, illustrations, texts, slogans, videos, etc.) are the exclusive property of the Domaine de Riva Bella.

No right of use may be granted in respect of the intellectual property rights appearing on the SITE. WE reserve the right to take legal action for any infringement of these intellectual property rights.

Reproduction of any documents published on the SITE is authorised solely for information purposes and for strictly personal and private use. Any total or partial reproduction and/or representation, use, adaptation or modification of the SITE or of any of its elements on any medium whatsoever, and in any form whatsoever, for any other purpose and in particular for professional purposes, is expressly prohibited.

Any reproduction and/or representation of the SITE or any of its components must be expressly authorised by US. Any unauthorised use constitutes an offence punishable by law.

Hypertext links to the SITE may only be created with the prior written consent of the Domaine de Riva Bella. The Domaine de Riva Bella is not responsible for the content, advertising, PRODUCTS or services available on or from websites linked to the SITE.

The trademarks mentioned on the SITE are registered and therefore protected and are the exclusive property of the Domaine de Riva Bella group.

Article 4.8 : Dispute

If you have a dispute with our establishment, you can contact us as follows:

- Send a letter by recorded delivery with acknowledgement of receipt to the village manager

- Send a copy of this letter to the customer service department at: rivabella.corsica@gmail.com If you are not satisfied with the response, you can refer the matter to the Medicys Mediation Centre, after a period of one month following the sending of these letters/emails. You must submit your case by post to: Medicys -73 Boulevard de Clichy -75009 PARIS.

Article 4.09 : Applicable law & Jurisdiction

These general conditions of sale, as well as the sale of PRODUCTS and Thalasso & Spa treatments, are subject to French law. Failing mediation, any dispute relating to the interpretation, performance or breach of contract between US and the BUYER will be subject to the exclusive jurisdiction of the French courts.

Article 5 : BEHAVIOUR 

From April to the beginning of November, the Holiday Residence and its beach are naturist but nudity is not compulsory at the Thalasso. If you do not practise naturism and wish to stay at Riva Bella during this period, it is of course possible: part of the beach is reserved for "Textiles", 800 m from the Thalasso.

The treatments we offer are aimed at well-being, relaxation and stress relief, in an healthy and respectful way, without any erotic dimension. We reserve the right to exclude immediately, definitively and without refund any person whose attitude runs counter to our ethics.
